Basic Bankruptcy

Course Description:
The course will cover the basics of bankruptcy law as an introductory bankruptcy manual for legal assistants. The scope of the course ranges from detailed procedural aspects of common bankruptcy litigation practice to the policy and history behind the bankruptcy law. The course will describe the differences of each chapter of bankruptcy code, the impact of the substantive rights and duties of the parties within each chapter, along with appropriate procedures and deadlines to protect such rights. Also covered will be an analysis of basic litigation issues such as stay relief, avoidance actions, dismissals, nondischargeables and confirmation matters. Students will draft the basic court documents, Chapter 7, 13 and I I petitions as well as basic bankruptcy litigation complaints. LEC
